O Fluminense será julgado hoje às 17h, pela Segunda Comissão Disciplinar do Tribunal de justiça Desportiva do Rio de Janeiro
Além de ser julgado pelos gritos de “time assassino”, o Fluminense precisará defender o auxiliar técnico Maurício Dulac pela expulsão no clássico. Ele foi enquadrado no artigo 258 II do CBJD, por “assumir qualquer conduta contrária à disciplina ou à ética desportiva: desrespeitar os membros da equipe de arbitragem, ou reclamar desrespeitosamente contra suas decisões”.
O juiz da partida também relatou na súmula que as duas equipes atrasaram o retorno ao gramado após o intervalo – o Flamengo ultrapassou um minuto o Fluminense dois. E, portanto, foram incursas no artigo 206, que diz: “dar causa ao atraso do início da realização de partida, prova ou equivalente, ou deixar de apresentar a sua equipe em campo até a hora marcada para o início ou reinício da partida”.
Apesar do fato ( os gritos ” time assassino) não ter sido relatado na súmula pelo árbitro, o clube foi denunciado pela Procuradoria e enquadrado em dois artigos: pelo teor discriminatório das palavras – 243-G do Código Brasileiro de Justiça Desportiva (CBJD) – e por descumprir o Regulamento Geral das Competições, Código Disciplinar da Fifa e Estatuto do Torcedor.
As provocações fizeram referência à tragédia do Ninho do Urubu que matou 10 jogadores da base rubro-negra em fevereiro de 2019
